Prosecution third witness in the case involving Bong County lawmaker representative Marvin Cole versus the Mbayo’s and Kerkula has told the court that journalist Bettie Johnson-Mbayo did not stone Rep. Cole as the lawmaker’s claimed.
Reginald Malcolm Holder, a neighbor of the lawmaker said in his testimony that if there was any stone thrown at the lawmaker, it is the burden of the prosecution to prove.
The prosecution witness also in his testimony revealed that a member of Rep. Cole’s household came out of the lawmakers’ fence and forcefully removed Dr. Moses Mbayo’s key from the vehicle.
He further explained that there were other members of the household who came out and cause a commotion that resulted in inflicting bruises on the Mbayo’s.
However, he failed to name the members of the household who inflicted bruises on the spouse.
Witness Holder also disclosed that excluding the Mbayo’s vehicle in a lane, there were other vehicles that were parked in the public alley.
“There were other cars parked opposite the honorable fence thus preventing his passage on the lane provided him and there was a traffic-jammed.”
He said he was not on the scene when the incident started but was present when an exchange of words ensued between the parties.

At the same time, Prosecution witness Nelson Kollie told the court that though the spouse’s vehicle was parked in the driveway, he managed to get his vehicle in the fence without the spouse removing their vehicle.

Even though, Representative Marvin Cole previously told the court that he was restrained from entering his fence because the Mbayo’s parked their vehicle in his driveway.
It can be recalled on February 1, Representative Cole told the Paynesville Magisterial court that he did not order thugs to beat on Journalist Bettie Johnson- Mbayo, Doctor Moses Mbayo, and Johnson Kerkula, principal of the St. Simon Baptist School at his Du-port road resident during a tension.
He, however, said, after the trio attacked his vehicle, he managed to enter his fence but “do not know what when on behind my back.”
On January 15, 2022, journalist Mbayo, her husband Dr. Mbayo, and Mr. Kerkula were allegedly ordered flogged by Rep. Cole because their vehicle was parked at the edge of his fence in an alley.
